This is the Leaftech Ag privacy policy. It stands alone. When it is attached to a Distributor Agreement, it is Exhibit B. This policy describes how Leaftech Ag Inc. (“Leaftech Ag,” “we,” “us”) collects, uses, and shares information when a distributor, reseller, or customer uses the Scan as a Service subscriptions, software, and related hardware (the “Services”). A distributor shall flow this policy and the end-user license agreement down to its customers and sub-distributors before first use, and shall not sell Customer Data.
1. Information we collect
We collect information you give us: name, business name, email, phone, billing address, and account credentials.
Payment card data is processed by our payment providers. We do not store full card numbers.
Through the Services we collect plant data from the scan and a geo reference for that scan. The customer provides the other inputs, which may include grower, farm, field, crop, growth stage, and other information the customer chooses to enter. We also collect account and device data needed to operate the scanner and the software, such as login, app version, and basic diagnostic logs. We do not collect soil tests, weather, irrigation, or equipment data unless the customer types that information in as a user input.
“Customer Data” means the plant data and geo reference generated by a scan, and the grower, farm, field, crop, growth-stage, and other inputs the customer provides. The customer retains ownership of Customer Data. Leaftech Ag has a non-exclusive license to use it to provide, secure, and improve the Services, as stated in the Distributor Agreement.
2. How we use information
We use information to provide, maintain, and secure the Services; process orders and payments; train and support distributors; communicate about the Services; analyze and improve the models and reports; and comply with law. Marketing email can be opted out of. transactional messages about an order, a scan, or a security incident are not marketing.
3. How we share information
We do not sell personal information. We do not share a distributor’s customer list, or Customer Data that identifies a distributor or a customer, with another distributor or reseller.
We share information with service providers that host, process payments, or support the Services, under confidentiality terms. We share with an agricultural partner only with consent. We share if required by law, to protect the rights and safety of users, or in a merger or sale of Leaftech Ag, in which case this policy still applies until a successor posts a new one. We may use and share aggregated or anonymized data that does not identify a distributor or a customer.
4. Your choices
Subject to law, you may access or update account information, opt out of marketing, request a portable copy where required, and request deletion, subject to records we must keep for legal, security, or accounting reasons. Contact [email protected]. We may verify identity before acting on a request. A customer should also contact the distributor that sold the Subscription if the request relates to that account.
5. Security and retention
We use reasonable administrative, physical, and technical safeguards, including encryption in transit and access controls. No method of storage is perfectly secure. We keep information as long as needed to provide the Services, meet a legal duty, or resolve a dispute, then delete or anonymize it. Scan hardware returned at the end of a Subscription is handled under the Distributor Agreement, not as a deletion request.
6. International transfers and children
The Services are operated from the United States, and information may be processed there. If information is transferred from another country, we use appropriate safeguards. The Services are not directed to children under 16. We delete information we know was collected from a child under 16.
7. Distributor duties
A distributor uses Customer Data only to perform its Distributor Agreement, flows this policy and the end-user license agreement down before first use, and does not sell Customer Data. A sub-distributor is bound only after it signs the joinder. This policy does not disclose a distributor’s wholesale prices.
8. Changes and contact
We may update this policy. The effective date above will change, and we will post the update at www.leaftechag.com. Continued use after the effective date is acceptance of the update. This October 5, 2026 policy replaces the policy effective May 12, 2025.
